Pursuant to Article IV, Section 14, of the Texas Constitution, I, Rick Perry, Governor of Texas, do hereby disapprove of and veto House Bill No. 3085 as passed by the Eighty-Third Texas Legislature, Regular Session, because of the following objections:
House Bill 3085 increases the maximum civil penalty from $1,000 to $5,000 a day for violations of the Transportation Code concerning salvage yards in the unincorporated areas of Harris County, which are defined as an area where three or more vehicles are being used for parts, or are kept for the purpose of an automotive repair or rebuilding business.
This low threshold means someone repairing vehicles as a side business, or even someone who owns a few cars with the intent to sell, could be subjected to these unnecessarily high daily penalties.
Since the Eighty-Third Texas Legislature, Regular Session, by its adjournment has prevented the return of this bill, I am filing these objections in the office of the Secretary of State and giving notice thereof by this public proclamation according to the aforementioned constitutional provision.
