Congresswoman Rosa DeLauro (D-CT) released the following statement on today's appeals court decision invalidating President Obama's recess appointments to the National Labor Relations Board (NLRB). DeLauro is the senior Democrat on the subcommittee responsible for funding the Labor Department.
"This is yet another erroneous court decision squarely at odds with longstanding practice. Presidents of both parties have routinely made hundreds of recess appointments during intra-session recesses and without regard to when the vacancy first arose. That includes four such NLRB recess appointments by President Reagan and four by the second President Bush.
"The best solution to today's decision is not a prolonged court battle, but a functioning confirmation process. Senate Republicans should stop blocking nominees and threatening filibusters and start allowing qualified nominees an up or down vote."
