Heller Bill Limits Federal Authority over Nevada Land

Press Release

Date: Sept. 14, 2011
Location: Washington, DC

Today, U.S. Senator Dean Heller (R-NV) introduced legislation limiting the federal government's ability to establish additional national monuments in the state of Nevada by requiring congressional approval.

"Nevadans have a right to provide their input into any process that could limit access to our own land. By requiring congressional approval, this bill utilizes the constitutional system of checks and balances to provide residents and local officials with ample opportunity to provide their opinion and evaluate the impact on local economies. The Administration should work closely with members of Congress in an open and transparent process before designating any national monuments," said Senator Heller.

Specifically, Heller's bill amends the Antiquities Act to prohibit further extension or establishment of national monuments in the State of Nevada except by express authorization of Congress. The bill also prohibits Bureau of Land Management from implementing Secretarial Order 3310 which prioritizes restrictive designations such as wilderness over other uses.
