Pitts on Harrisburg Federal Court Ruling Striking Down Health Care Mandate

Statement

A federal judge in Pennsylvania ruled today that the mandate to purchase health insurance contained in the Patient Protection and Affordable Care Act is unconstitutional. This ruling is in response to a lawsuit filed by a York County couple.

Rep. Pitts' statement follows:

"Yet another federal court, this time in my home state of Pennsylvania, has concluded that the mandate to purchase health insurance contained in last year's health care law is unconstitutional. The U.S. Constitution sets clear boundaries for the federal government, but last year's law runs roughshod over our protected liberties.

"The uncertainty over whether the health care law will stand and what it will do to businesses is already contributing to slow job growth. The Obama administration could have requested a prompt review by the U.S. Supreme Court, but instead we will probably have to wait at least another year before a final decision is made. The law should not be allowed to stand and we should do away with it as soon as possible so that we can enact real reforms. Reforms that bring down the cost of insurance and encourage job creation."
