Dear Attorney General King:

Currently a bi-partisan group of 14 Attorneys General from throughout the United States have filed suit against the federal government challenging, amongst other provisions, the Constitutionality of the healthcare legislation recently signed into law by President Barack Obama. We write today to urge you to join this group of Attorneys General and file suit in order to protect the interests of the citizens of New Mexico and the principles of the Constitution of the United States.

The Patient Protection and Affordable Care Act (H.R. 3590, PL# 111-148) is an overreaching and unconstitutional exercise of federal power. Based upon the sound foundation and principals established by the 9th Amendment and the 10th Amendment to the Constitution, this federal healthcare act clearly violates the Constitution, as the federal government has assumed un-delegated powers in enacting this legislation.

This is the first time in American history that we can remember our federal government violating the Constitution and punishing New Mexicans, and all American citizens, for any kind of economic inactivity. The Constitution does allow for Congress to regulate interstate commerce, but does not allow them to tell Americans what they must purchase.

As leaders in the State of New Mexico we respect that our powers are derived from our Constitution. We respectfully request that you stand with the 14 other states in filing suit to uphold the Constitution of the United States.
