Supreme Court Applies Second Amendment to State and Local Governments

In the case of McDonald v. Chicago, the Supreme Court this week ruled 5-4 that the Second Amendment applies to state and local governments. This decision resolved conflicts between certain Chicago gun restrictions and the Second Amendment. Specifically, the Supreme Court held that the right of an individual to keep and bear arms under the Second Amendment is incorporated by the Due Process Clause of the Fourteenth Amendment to the United States Constitution and applies to the states. Congressman Miller believes firmly that no state has the right to legislate away the Constitutional right of every law-abiding American to protect their life and liberty, and applauds the Supreme Court for upholding the Constitution.
