Smith Hails Supreme Court Decision Overturning Chicago Gun Ban

Congressman Adrian Smith (R-NE) today issued the following statement praising the U.S. Supreme Court's decision in the case of McDonald v. City of Chicago. By a 5-4 decision, the court upheld a federal appeals court ruling overturning a law prohibiting private citizens from possessing handguns in the city of Chicago. The decision effectively guarantees the Second Amendment's protections at the state and local levels.

"This is a momentous decision. I commend the justices for protecting all Americans' right to gun ownership, though the close margin of the decision underscores the necessity to remain vigilant. The Second Amendment to the Constitution guarantees an individual's right to keep and bear arms; however, for too long this right has been denied to some Americans simply because of where they live," Smith said.

"Local laws such as this one fly in the face of our heritage. As a member of the National Rifle Association, I am committed to supporting efforts to protect the constitutional rights of all law-abiding, gun-owning Americans."

Smith signed an amicus curiea - a "friend of the court" brief - in the McDonald case. The brief called on the Supreme Court to preserve Americans' right to bear arms and uphold the Second Amendment as it applies to state and local governments through the Fourteenth Amendment. The amicus brief was signed by more than 300 Members of Congress from both parties and chambers of Congress.
