FEDERAL COURT DECIDES FCC FAILED TO SHOW AUTHORITY TO REGULATE INTERNET CONGESTION

"The Internet has flourished under market forces and without heavy-handed regulation," stated Rep. Cliff Stearns (R-FL), Ranking Member on the House Communications, Technology and the Internet Subcommittee, "and this decision that the Federal Communications Commission (FCC) failed to demonstrate regulatory authority will help maintain Internet freedom."

The U.S. Court of Appeals for the District of Columbia Circuit today ruled against the FCC's claim of authority over Internet provider's network management practices. "The FCC opened a public comment period for implementing Net Neutrality regulations that is still open. This case demonstrates the legal and policy dangers of overreaching by the FCC. The decision whether to reconsider the existing statutory policy in section 230 of refraining from federal or state regulation of the Internet should be left to Congress," added Stearns. "I am concerned that Net Neutrality regulations could hamper Internet development and deter needed investments. Vibrant competition among providers will continue to ensure Americans benefit from a robust and innovative Internet."
