Issue Position: The Second Amendment
The U.S. Constitution affirms in the Second Amendment that, " the right of the people to keep and bear Arms, shall not be infringed." Citizens must be able to continue to defend themselves, their families and their homes. I am committed to protecting our right to own and bear arms.
The 109th Congress (2005-2006) represented one of the most successful congressional sessions for gun owners and their advocates. Two important pieces of pro-gun legislation were signed into law during the 109th Congress. The Disaster Recovery Personal Protection Act (Public Law 109-295) prevents confiscation of law-abiding citizens' firearms at the time they need them most - that is, in the aftermath of a major disaster when government is unable to provide reliable protection from crime. In addition, the Protection of Lawful Commerce in Arms Act (Public Law 109-92 ) prohibits civil liability actions from being brought or continued against manufacturers, distributors, dealers, or importers of firearms or ammunition resulting from the misuse of their products by others. I was a cosponsor of both of these bills in the House and was proud to see each signed into law.
The U.S. Supreme Court is currently considering District of Columbia v. Heller, a case which will test the constitutionality of the District of Columbia's strict gun control laws. I believe the ramifications of this case will extend well beyond the geographical boundries of the District of Columbia. A victory for the petitioner in this case (the District of Columbia) would embolden other local governments to adopt similar measures. I am working hard with my colleagues in Congress to ensure that our inherent rights to keep and bear arms are not infringed. I firmly believe that law-abiding citizens have the right to own guns and will continue to be an advocate for our Second Amendment rights both now and in the future.
