SENATOR EDWARD M. KENNEDY STATEMENT ON THE DEAL REACHED BETWEEN SENATE DEMOCRATS AND THE WHITE HOUSE ON JUDICIAL NOMINATIONS

The deal, while welcome, doesn't change the fact that the two recess appointments President Bush has made are an affront to the constitutional role of the Senate and totally inappropriate.

I have already suggested to the judges on the 11th Circuit Court of Appeals that they need to consider whether Mr. Pryor's appointment is invalid, since his participation could infect all the cases he sits on with legal error.

I expect the 11th Circuit and the Supreme Court will still have to rule on that issue unless he steps down in recognition of the White House agreement to refrain from such appointments.
