Smith: SCOTUS Ruling Jeopardizes National Security
Judiciary Committee Ranking Member Lamar Smith (R-TX) issued the following statement regarding today's Supreme Court decision to grant foreign terrorists held at Guantanamo Bay the constitutional right to challenge their detention:
"Today's Supreme Court decision to grant unprecedented rights to foreign terrorists places the American people at risk. Congress carefully crafted procedures by which foreign terroristswho do not have protections under the Constitutionreceive fair and due process. By overturning this Congressionally-approved process, the Court has placed the rights' of foreign terrorists over the safety and security of the American people."
As part of today's 5-4 ruling, the four dissenting Justices, including Chief Justice John Roberts, stated that the Court today "struck down as inadequate the most generous set of procedural protections ever afforded aliens detained by this country as enemy combatants." The dissenting Justices concluded, "All that today's opinion has done is shift responsibility for those sensitive foreign policy and national security decisions from the elected branches to the [unelected] Federal Judiciary."
