SCHWARZ SUPPORTS PRIVATE PROPERTY RIGHTS 6/28/2006

U.S. Rep. Joe Schwarz, M.D. (R-Battle Creek) has agreed to sign on as a cosponsor to H. Res. 880. This resolution expresses the sense of the House that it continues to disapprove of the U.S. Supreme Court's decision one year ago in Kelo, et al v. City of New London.

"Last year, the Supreme Court gave local governments vast power to seize private property with its ruling in the Kelo case," said Congressman Schwarz. "One of our most precious rights is the right to own property. I find this ruling unacceptable because of the broad manner in which it infringes on this fundamental right."

On November 3, 2005, Congressman Schwarz voted in favor of the Private Property Rights Protection Act of 2005, H.R. 4128, which overwhelmingly passed the House by a vote of 376 - 38. This bill contains provisions to deny federal economic development funding to state and local governments that abuse eminent domain for private commercial development, as in the Kelo case.

"I am a steadfast supporter of private property rights," said Congressman Schwarz. "And I will continue to fight for the protection of homes and small businesses and other private property against unreasonable government seizure or interference."
