Title: Implementing Measure 57
Vote Smart's Synopsis:
Vote to pass a bill that temporarily suspends some provisions of Ballot Measure 57, provides new guidelines regarding presumptive sentences and probation, and allocates saved money to public safety operations.
Highlights:
-Sets standards by which the Board of Parole and Post-Prison Supervision shall set hearings for and grant changes in the terms of confinement for a range of prisoners, including those convicted of aggravated murder or murder, crimes committed before Nov. 1, 1989, and prisoners who have a severe emotional disturbance that may constitute a danger to the public (Secs. 1-6).
-Reduces, beginning on February 15, 2010, sentence guidelines increased under Measure 57 for a variety of crimes relating to property and drug use (Secs. 8, 9, 15, 31, 49).
-Sunsets these sentence reductions on January 1, 2012, thereby restoring sentences to the levels mandated by Measure 57 (Sec. 10, 11, 14, 16, 49).
-Allows for an increase in the amount of time credits (time earned/early release) a prisoner may receive for good behavior from 20% to 30% of the total term of incarceration. Exempts violent crimes, including: rape, sodomy, sexual abuse, criminally negligent homicide, assault as well as those convicted of attempting these crimes (Sec. 17,18).
-Sunsets the increase in the maximum percentage of sentence reduction available to non-violent offenders on July 1, 2013 (Sec. 19).
-Lowers the maximum additional prison sentence for individuals on probation who violate the terms of their probation to 60 days, provided the individuals violation is not the commission of a new crime (Sec. 20).
-Sunsets the decrease in the maximum additional prison sentence for probation violation and replaces the original limit of 180 days on January 1, 2012 (Sec. 32).
-Dedicates money saved through provisions of this act to the Department of State Police and the Department of Corrections for public safety operations and to the Oregon Youth Authority for other purposes related to public safety (Sec. 46).
