Title: Legalize Medical Marijuana

Vote to pass a bill that legalizes the use of marijuana in treating serious diseases.

Highlights:
-Establishes protection of patients with serious medical conditions, their doctors, and their primary caregivers from arrest, prosecution, or penalties for the authorized medical use of cannabis (Sec. 5). -Defines the maximum amount of cannabis a patient may legitimately possess as 2 ounces of dried usable cannabis and 6 cannabis plants, of which only 3 can be mature plants, and mandates that a medical cannabis organization may not possess more cannabis than the maximum amount that may be legitimately prescribed to all of its registered patients (Sec. 10). -Specifies the serious medical conditions for which cannabis may legally be used (Sec. 10):
    -Cancer; -Glaucoma; -HIV; -AIDs; -Amytrophic lateral sclerosis; -Crohn's disease; -Agitation of Alzheimer's; -Nail patella; -Chronic debilitating conditions producing cachexia, seizures, muscle spasms, intractable pain, and nausea; or -Any other condition approved by the Department of Public Health.
-Prohibits the seizure of cannabis used for medical purposes (Sec. 15). -Establishes a $3 fee to be paid by qualifying patients for the purpose of educating the public about the dangers of cannabis and prescription abuse (Sec. 20). -Establishes an application process for patients who wish to use cannabis for medical purposes and provides for the confidentiality of their personal information (Sec. 25). -Requires parental consent before a patient under the age of 18 may receive authorization for the medical use of cannabis (Sec. 25). -Prohibits the possession and use of cannabis in schools, workplaces, and public places, the operation of vehicles while under the influence of cannabis, and the use of cannabis without a serious medical condition (Sec. 30). -Establishes an application process and rules for organizations providing cannabis to patients for medical purposes (Sec. 45). -Establishes protection of organizations providing medical cannabis and their employees from prosecution or penalties for the legitimate distribution of medical cannabis (Sec. 45). -Expands the originally proposed felony classifications of the following violations for persons authorized under this act to produce, possess, or deliver the cannabis sativa plant who knowingly do so except as provided for in this act (Sec. 95):
    -Not more than 5 plants from a Class A misdemeanor to a Class 4 felony; -More than 5 but under 20 plants from a Class 4 felony to a Class 3 felony; -More than 20 but under 50 plants from a Class 3 felony to a Class 2 felony; -More than 50 but not more than 200 plants from a Class 2 felony to a Class 1 felony; and -More than 200 plants from a Class 1 felony to a Class X felony.
-Requires that any registered patient or primary caregiver who distributes cannabis to an unqualified person be subject to a penalty enhancement of not more than 2 years in prison and/or a fine of not more than $2,000 (Sec. 95).
