Title: Out-of-State Health Insurance

Vote not to pass a bill that permits out-of-state health insurers to offer their individual and group plans to individuals and groups in the state of Maine, if certain requirements specified in this bill are met.

Highlights:
-Allows regional insurers and health maintenance organizations to provide individual health insurance to residents of the State of Maine. Regional insurers are listed are being in the following states: Connecticut, Massachusetts, New Hampshire, Rhode Island, and Vermont. (Sec. 1). -Prohibits regional insurers from transactions involving individual or group health insurance by mail, the Internet, or otherwise unless the superintendent issues authorization that requirements of this bill have been met. The Superintendent shall issue certification within thirty days of the request (Sec. 2). -Requires the regional insurer or health maintenance organization to designate an agent for receiving service of legal documents (Sec. 2). -Mandates that regional insurer or health maintenance organization must comply with court orders (Sec. 2). -Requires the regional insurer or health maintenance organization shall participate in an insurance insolvency guarantee association (Sec. 2). -Requires a certificate of authority and compliance with the laws of the originating state, required disclosure and reporting, and proper grievance procedures (Sec.3).

Vote on a motion to not pass a bill that would allow Maine residents to purchase health insurance from an insurer located in any of the New England states.

Highlights:
-Defines “regional insurer or health maintenance organizations” as an organization that holds a valid certificate of authority to transact health insurance in one of the following states: Connecticut, Massachusetts, New Hampshire, Rhode Island and Vermont (Sec. 2). -Requires out-of-state health insurers to comply with applicable Maine health insurance laws, including minimum capital and surplus and reserve requirements (Sec. 2). -Requires out-of-state health insurers to provide adequate disclosure of how the plans differ from Maine health plans to prospective enrollees (Sec. 2). -Permits Maine health insurers to offer individual health plans of out-of-state parent or subsidiary health insurers if similar requirements are met (Sec. 3).
