Title: Amendments to Attorney Fee Cap in Workers Compensation Lawsuits
Vote to adopt an amendment to HB 903 that substitutes the entire text of the bill and replaces the existing attorney fee schedule for workers' compensation lawsuits with a new schedule with additional provisions related to costs incurred by employers and insurance carriers.
- - Existing law:
- - 20 percent of the first $5,000 of the amount of benefits secured;
- 15 percent of the next $5,000 of the amount of benefits secured;
- 10 percent of the remaining amount of the benefits secured to be provided during the first 10 years after the date the claim is filed; and
- 5 percent of the amount of the benefits secured after 10 years;
- - 25 percent of the first $5,000 of the amount of benefits secured;
- 20 percent of the next $5,000 of the amount of benefits secured; and
- 15 percent of the remaining amount of the benefits secured.
