Vote to pass a bill that prohibits smoking or carrying of any lighted tobacco product in public places or places of employment.

Highlights:

-Excludes sleeping rooms in any hotel or lodging establishment in which the rooms are rented to guests and posted as smoking rooms (Sec. 5). -Excludes businesses that met the following requirements on January 1, 2009 and continue to meet them thereafter (Sec. 6):

-At least 10 percent of gross income must be generated from cigar sales; -A humidor must be on the premises; and -A separate ventilation system must be present to prevent smoke from being recirculated into no-smoking areas.

-Excludes fully-enclosed retail tobacco stores if 65 percent of gross income is generated from the sale of tobacco products and related accessories and alcohol consumption is prohibited on the premises (Sec. 7). -Specifies that violators of the smoking ban and persons who own, manage, or operate a public place or place of employment who fail to inform violators about the ban are guilty of a petty offense (Sec. 2).
