Vote Smart's Synopsis:

Vote to pass a bill that bans smoking in enclosed public places and other areas beginning January 2, 2010.

Highlights:

-Prohibits smoking in enclosed areas, including but not limited to the following (Sec. 3):

-Public places; -Taxis and limousines; -Restrooms, lobbies, hallways, and other common areas in public and private buildings, condominiums, other multiple residential buildings, hotels, and motels; -At least 80 percent of the sleeping quarters within a hotel or motel; -Access points of buildings and facilities; and -Any place of employment.

-Exempts the following locations from prohibition (Sec. 3):

-Outdoor areas of buildings beyond the access points; -Private residences unless the residence is a day care; -Designated hotel or motel rooms; -Gaming floors of racetrack or lottery facilities; -Tobacco shops; -Designated portions of adult care homes; -Designated portions of licensed long-term care units of medical care facilities; and -Class A or B clubs that notify the Secretary of Health and Environment that they wish to be exempt.

-Establishes fines equal to $100 for the first violation, not more than $200 for a second violation that occurs within a year of the first violation, and not more than $500 for every subsequent violation that occurs within a year of the first violation (Sec. 5). -Specifies that day care homes that violate provisions of this bill may be subject to criminal punishment in addition to fines (Sec. 6).
