Vote to pass a bill that allows a utility to recover from its customers the costs of constructing a certified nuclear generating plant by charging a rate tariff that is allocated on an equal percentage basis to standard base tariffs which are designed to recover embedded capacity costs.

Highlights:
-Authorizes a utility to begin recovering costs for a nuclear generating plant certified on or after July 1, 2009 at any time within five years after the date the plant is certified (Sec. 2). -Authorizes a utility to begin recovering costs on January 1, 2011 for a nuclear plant certified on or after January 1, 2009 and before July 1, 2009 (Sec. 2). -This is a substitute bill sponsored by the Senate Regulated Industries and Utilities Committee.
