Title: Increasing Vehicle Fees to Fund Transportation Projects

Vote to pass a bill that increases vehicle fees to fund surface transportation projects, and establishes the High-Performance Transportation Enterprise to pursue public-private partnerships to complete surface transportation projects, including through the use of toll highways, provided that they adhere to specific restrictions.

Highlights:

-Establishes a road safety surcharge imposed upon the registration of any vehicle for which a registration fee must be paid to be deposited into the Highway Users Tax Fund. The surcharge shall be equal to the following (Sec. 1):

    -$16 for any vehicle that is a motorcycle, motorscooter, or motorbicycle, or that weighs 2,000 lbs or less; -$23 for any vehicle that weighs more than 2,000 lbs but not more than 5,000 lbs; -$28 for any vehicle that weighs more than 5,000 lbs but not more than 10,000 lbs; -$37 for any vehicle that is a passenger bus or that weighs more than 10,000 lbs but not more than 16,000 lbs; and -$39 for any vehicle that weighs more than 16,000 lbs.

    -$13 for any vehicle that is a motorcycle, motorscooter, or motorbicycle, or that weighs 2,000 lbs or less; -$18 for any vehicle that weighs more than 2,000 lbs but not more than 5,000 lbs; -$23 for any vehicle that weighs more than 5,000 lbs but not more than 10,000 lbs; -$29 for any vehicle that is a passenger bus or that weighs more than 10,000 lbs but not more than 16,000 lbs; and -$32 for any vehicle that weighs more than 16,000 lbs.
-Limits the bridge safety surcharge to 50 percent of the maximum amount of the surcharge for the 2009-2010 fiscal year and 75 percent of the maximum amount of the surcharge for the 2010-2011 fiscal year (Sec. 1). -Reduces the road safety surcharge and bridge safety surcharge by half if the vehicle is a truck or tractor that is owned by a farmer or rancher and is used commercially to do one of the following (Sec. 1):
    -Transport raw agricultural products produced by the farmer or rancher or livestock raised by the farmer or rancher to the market or place of storage; or -Transport commodities or livestock purchased by the farmer or rancher for personal use in the farming or ranching operations.
-Requires there be a daily vehicle rental fee of $2 per day for any vehicle rented in the state to be deposited into the Highway Users Tax Fund, and exempts those vehicles from the road safety surcharge and bridge safety surcharge (Sec. 1). -Establishes a supplemental oversize, overweight, and overlength vehicle surcharge imposed upon the issuance of a single trip permit to be deposited into the Highway Users Tax Fund. The surcharge shall be equal to the following fees for single trip permits, as provided by existing law (Sec. 1):
    -$15 for overlength, overwidth, and overheight permits on loads or vehicles which do not exceed legal weight limits; -$15 plus $5 per axle for overweight permits for vehicles or loads exceeding legal weight limits up to 200,000 lbs; and -$125 for special permits for structural, oversize, or overweight moves requiring extraordinary action or moves involving weight in excess of 200,000 lbs.
-Exempts vehicles from the supplemental oversize, overweight, and overlength vehicle surcharge listed above if a single trip permit was charged for overweight permits for divisible vehicles or loads exceeding legal weight limits ($30 plus $10 per axle) (Sec. 1). -Establishes a supplemental unregistered vehicle fine, in addition to other fines provided by existing law, imposed upon conviction of a misdemeanor for knowingly failing to register a vehicle within 30 days of becoming a resident of the state equal to $500 to be deposited into the Highway Users Tax Fund (Sec. 1). -Establishes the Statewide Bridge Enterprise as a state-owned business within the Department of Transportation, in which the revenue from the bridge safety surcharge will be deposited and used to finance, repair, reconstruct, and replace bridges that have been identified by the Department of Transportation as structurally deficient or functionally obsolete and have been rated by the Department as poor (Sec. 1). -Establishes the High-Performance Transportation Enterprise as a state-owned business within the Department of Transportation to find means by which to complete surface transportation infrastructure projects, and is authorized do the following (Sec. 1):
    -Impose user fees for the privilege of using surface transportation infrastructure, provided that they adhere to toll highway restrictions established by this Act; -Issue or reissue revenue bonds; -Contract with other governmental or nongovernmental source of funding for loans or grants; and -Pursue and enter into public-private partnerships.
-Establishes restrictions on the establishment of toll highways by the High-Performance Transportation Enterprise or any partner thereof, including, but not limited to, the following requirements (Sec. 1):
    -Ensuring unrestricted access by all vehicles to the toll highway and not requiring that a particular class of vehicles travel on the toll highway, with some exceptions; -Authorizing any public transportation vehicle to travel on the toll highway without paying a user fee; -Obtaining any required federal approval; -Obtaining the approval of every local government whose jurisdiction includes territory in which all or any portion of the toll highway is present or will otherwise by substantially impacted by the imposition of the toll highway; -Incorporating congestion management and congestion pricing into the schedule of user fees; -Authorizing the investment of highway-derived user fee revenues for cost-effective multimodal transportation projects that promote mobility, reductions in the emission of greenhouse gas, and energy efficiency; -Considering whether the completion of the project will help to reconnect or reintegrate any local government or other other community that has been disconnected or divided by existing transportation infrastructure; and -Preparing a local air quality impact statement and a local community traffic safety assessment that specifically take into account an diversion of vehicular traffic from the highway segment or highway lanes onto other highways, roads, or streets that is expected to result from the imposition of a user fee.
