Title: Carbon Monoxide Detector Requirements

Vote to pass a bill that requires all new single and multi-family homes built or sold on or after July 1, 2009, and all rental properties and apartment buildings in which a lease is signed or renewed on or after July 1, 2009, to have operational carbon monoxide detectors installed within 15 feet of a bedroom if the dwelling is equipped with a fuel-burning heater, fireplace, or attached garage.

Highlights:

-Establishes maintenance requirements for landlords of rental property, including the requirement that carbon monoxide detectors be replaced if notified by the tenant that the detector(s) was stolen, removed, found missing, or found not operational (Sec. 2). -Establishes maintenance requirements for tenants of rental property, including the requirement that they keep, test, and maintain all carbon monoxide detectors and notify the landlord in writing if the batteries need to be replaced or if they are found not operational (Sec. 2). -Prohibits the removal of batteries from a carbon monoxide detectors by any individual, unless they are doing so to inspect, maintain, repair, or replace the detector or batteries of the detector (Sec. 2). -Specifies that the provisions of this Act do not limit the ability of a municipality, county, city, or other local governmental entity from adopting or enforcing more stringent standards (Sec. 2).
