Title: Expediting Local-Option Tax Approval in Disaster Areas

Vote Smart's Synopsis:

Vote to pass a bill that allows a city or unincorporated area located in a county in which the President declared a disaster to exist during 2008 to impose a local option sales and services tax beginning as early as April 1, 2009.

Highlights:
-Requires a majority vote of the electors in a city or unincorporated area favoring imposition of the tax before it may be imposed (Sec. 1). -Sets deadlines of either February 3, 2009 or March 10, 2009 for city or county governments to submit a motion requesting an election on the question of imposing the tax, and specifies that the election shall be held on March 3, 2009 if the first deadline is met or May 5, 2009 if the second deadline is met (Sec. 1). -Specifies that a tax approved at an election held on March 3, 2009 shall be imposed beginning April 1, 2009, and that a tax approved at an election held on May 5, 2009 shall be imposed beginning July 1, 2009 (Sec. 1). -Prohibits a city or area in which a local option sales and services tax is already imposed on the effective date of this bill from imposing an additional tax pursuant to this bill (Sec. 1).
