Vote to pass a joint resolution that declares the Sixty-First Montana Legislature's "adamant opposition" to the federal passage of the Clean Water Restoration Act of 2007 (H.R. 2421), its companion bill (S. 1870), and any future bills of similar language, which amends the Federal Water Pollution Control Act (Clean Water Act) to replace the phrase "navigable waters" with "waters of the United States" with respect to the jurisdiction of the Environmental Protection Agency (EPA).
Highlights:
-Specifies that definition of "waters of the United States" in the bill reads: "all waters subject to the ebb and flow of the tide, the territorial seas, and all interstate and intrastate waters and their tributaries, including lakes, rivers, streams (including intermittent streams), mudflats, sandflats, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, natural ponds, and all impoundments of the foregoing."
-Alleges that such an expansion of EPA jurisdiction could "blur jurisdictional authority to manage and regulate water resources within state and local government jurisdictions."
