Title: Prohibiting Resale of Recalled Products

Vote Smart's Synopsis:

Vote to concur with Senate amendments and pass a bill that prohibits the manufacture, sale, or distribution of products that have been recalled because they fail to conform with federal or state product safety laws or are labeled hazardous by the federal Consumer Product Safety Commission.

Highlights:
- Specifies that within 24 hours of receiving a recall notice for a product that is already on the market, dealers, manufacturers, or distributors must contact all of their customers and update their Web site about the recall with a description and picture of the product, reason for recall, and instruction on how to participate in the recall [sec. 2 (108046) (a) (1-2)]. - Specifies that within three days of receiving a recall notice, if having sold the product in the previous 18 months, the retailer must remove the product from their shelves and, if applicable, from their Web site [sec. 2 (108046) (c) (1-2)]. - Subjects violators of the provisions of this Act to a civil penalty of up to $1,000 for each infraction, not to exceed a total of $20,000 for all infractions [sec. 2 (108050) (a)].
