Title: Nutritional Information Disclosure in Chain Restaurants

Vote Smart's Synopsis:

Vote to concur with House amendments and pass a bill that requires chain restaurants that own at least 20 food facilities within the state to display the caloric content of all food items in a clear and conspicuous manner next to the item on all menus, menu boards, and/or display tags beginning January 1, 2011.

Highlights:
- Requires that during the period of July 1, 2009 to December 30, 2010, all restaurants that do not provide sit down service must disclose nutritional information in a brochure or other supplemental material, and for drive-through areas to have a conspicuous display that says, "Nutrition Information is Available Upon Request" [sec. 2 (b)]. - Specifies that nutritional information must include, but is not limited to, the caloric intake, total grams of carbohydrates, total grams of saturated fat, and total milligrams of sodium [sec. 2 (a) (5)]. - Requires brochures to include the statement: "Recommended limits for a 2,000 calorie daily diet are 20 grams of saturated fat and 2,300 milligrams of sodium" [sec. 2 (g) (1)]. - Allows restaurants to include on their menus and menus boards a disclaimer that indicates that variations exist in nutritional content based on variations in size and quantities of ingredients and special orders [sec. 2 (g) (2)]. - Imposed a fine of at least $50 and not more than $500 for each violation of this Act [sec. 2 (2) (k)].
