A vote to pass a bill that bans late-term/partial-birth abortions.
Highlights:
- Makes it a felony to perform a late-term/partial-birth abortion, with punishment of imprisonment for not more than two years or a fine of not more than $50,000 or both (Sec. 90).
- Allows late-term/partial-birth abortions to be performed if a physician determines the procedure is necessary to save the life of a woman "whose life is endangered by a physical disorder, physical illness, or physical injury" (Sec. 90).
- Notes that a woman who obtains or seeks to obtain a late-term/partial-birth abortion is not to be considered a conspirator to violate this act (Sec. 90).
- Asserts that late-term/partial-birth abortions are never medically necessary to preserve the health of the mother (Sec. 90).
- Allows the spouse of a woman (or a parent of a girl who is not yet 18 years old at the time of the procedure) to file a civil action against a physician who illegally performs a late-term/partial-birth abortion, unless the pregnancy is the result of the plaintiff's criminal conduct or if the plaintiff consented to the procedure (Sec. 90).
-Defines late-term/partial-birth abortion as an abortion in which a person "deliberating and intentionally vaginally delivers a living fetus until, in the case of a headfirst presentation, the entire fetal head is outside the body of the mother, or, in the case of a breech presentation, any part of the fetal trunk past the naval is outside the body of the mother, for the purpose of performing an overt act that the person knows will kill the partially delivered living fetus and performs the overt act that kills the partially delivered living fetus rather than completing the delivery" (Sec. 90).
