Highlights:

- Requires persons who operate all-terrain vehicles or off-highway vehicles (OHV) to obtain "user indicia" from the state, as well as special license plates (Sec. 5, Sec. 9). - Establishes a $3 vehicle license tax for these new special license plates (Sec. 10). - Exempts OHV use on private land and OHV use by individuals for strictly agricultural, ranching, mining, or construction purposes from the "user indicia" requirement (Sec. 5). - Requires the Director of the Department of Transportation to implement procedures to systematically replace any old OHV license plates and provide the new OHV license plates on or before July 1, 2009 (Sec. 9). - Prohibits OHV users on public lands from driving off of existing roads or marked trails in a manner that damages wildlife habitat, riparian areas, cultural or natural resources, or the environment, including excessive pollution of the air, water, or land; and violators shall be guilty of a class 3 misdemeanor (Sec. 2). - Directs funding for educational programs about OHV safety and environmentally responsible use, as well as for the maintenance, repair, and restoration of OHV routes and law enforcement along them (Sec. 4). - Prohibits individuals under 18 years old from operating or riding an OHV on public lands unless that person is wearing protective headgear (Sec. 5). - Provides that provisions of this OHV recreational plan be updated every five years and be submitted to public input (Sec. 12).
