Title: Undocumented Immigrants

Vote to adopt a conference report of an omnibus bill regarding undocumented immigrants.

Highlights:

-Requires the superintendent of the Missouri state highway patrol to designate members of the highway patrol to be trained to enforce federal immigration laws while performing their normal duties (Sec. A). -Withholds state funds from municipalities that enact any policy that limits or prohibits any person employed by the municipality from communicating or cooperating with federal agencies to verify or report the immigration status of any undocumented immigrant within the municipality or any policy that grants illegal immigrants lawful presence within the municipality (Sec. A). -Prohibits undocumented immigrants from receiving state or local public benefits including grants, contracts or loans from government agencies, welfare, health, postsecondary education, scholarships, disability, housing, or food assistance (Sec. A). -Prohibits this section from being construed to deny undocumented immigrants emergency medical care, prenatal care, services offering alternatives to abortion, or legal assistance (Sec. A). -Requires state courts to fine employers who knowingly misclassify or employ undocumented immigrants $50 per illegal employee, per day, up to a maximum of $50,000 (Sec. A). -Requires any business entity that is awarded a contract or grant from the state to verify by sworn affidavit and documentation that it participates in a federal work authorization program (Sec. A). -Allows state officials, business entities, or state residents to file complaints with the state attorney general regarding businesses or individuals who violate this act and requires the attorney general to act on valid complaints (Sec. A). -Delineates penalties for companies that hire or employ undocumented immigrants by requiring that the company's business permit and relevant licenses be suspended for 14 days upon the first offense, one year upon the second offense, and permanently upon the third offense (Sec. A). -Prohibits the department of revenue from issuing a driver's license to any undocumented immigrant and specifies that the written driver's license test shall only be administered in English (Sec. A). -Prohibits the release of incarcerated undocumented immigrants on bail and requires law enforcement to report to the U.S. Department of Homeland Security if it is determined that an inmate is an undocumented immigrant (Sec. A). -States that any company that participates in a federal work authorization program shall have an affirmative defense that such company has not knowingly hired or employed undocumented immigrants (Sec. A).
