Title: Parental Consent for Underage Abortions

Vote on a motion to declare inexpedient to legislate a bill that requires parental or guardian consent before performing an abortion upon an unemancipated minor.

Highlights:

- Requires the consent of both parents to perform the abortion, with the following exceptions (Sec. 1):

    - If one parent has died or is otherwise unavailable, consent of the remaining parent shall be sufficient; - If both parents have died or are otherwise unavailable, consent of the minor's guardian or guardians shall be sufficient; or - If the minor's parents are divorced, consent of the parent having primary residential responsibility shall be sufficient.
- Waives the parental consent requirement if a medical emergency exists, meaning the abortion is necessary to protect the life or mental well-being of the minor (Sec. 1). - Permits a judge to waive the parental consent requirement if the judge determines that the minor is mature and capable of giving informed consent (Sec. 1). - Permits a judge to waive parental consent requirement if the judge determines that the minor is not mature, but undergoing the abortion without parental consent would be in the best interest of the minor (Sec. 1). - Defines an "emancipated minor" as a minor (under the age of 18) who is or has been married, or has by court order been released from the care, custody, or control of his or her parents (Sec. 1). - Classifies a violation of the parental consent requirement as a misdemeanor, and such violation shall be grounds for a civil action (Sec. 1).
