Title: Off-Highway Vehicle Regulations

Vote Smart's Synopsis:

Vote to pass a bill that establishes an annual registration process for off-highway vehicles and applies additional regulations to off-highway vehicles.

Highlights:
- Requires the operator of an off-highway vehicle to annually apply for and display an indicia issued by the Department of Transportation. The Department will also establish a user fee to obtain a the indicia, of which 70 percent will be deposited into the off-highway recreation fund, and 30 percent will be deposited into the Arizona highway user revenue fund (Sec. 5). - Requires the vehicle to be designed by the manufacturer primarily for travel on unimproved terrain and have an unladen weight of 1,800 pounds or less in order to obtain an off-highway vehicle user indicia (Sec. 5). - Classifies the following as a class three misdemeanor (Sec. 2):
    - Operating an off-highway vehicle off of an existing road, trail, or route in a manner that causes damage to wildlife habitat, riparian areas, cultural or national resources or property or improvements; - Operating an off-highway vehicle on roads, trials, routes or areas that are identified as closed; - Operating an off-highway vehicle on unimproved roads, trails, routes or areas unless otherwise allowed by rule or regulation; - Operating an off-highway vehicle in a manner that damages the environment, including excessive pollution of air, water, land, abuse of watershed, cultural or natural resources or impairment of plant or animal life; and - Removing a regulatory sign governing off-highway vehicle use on any public or state land.
- Appropriates 35 percent of the off-highway vehicle recreation fund to informational and educational programs on safety and the environment with respect to off-highway vehicle use, 5 percent for expenses related to allowing off-highway vehicles to cross state trust land on existing routes, and 60 percent to construct and maintain routes and trails, enforce regulations, administer the fund, and mitigate damages (Sec. 4).
