- Allows the Governor, at the request of the school board, to change the position of county superintendent from an elective office to an appointive office if the district is designated as underperforming for two consecutive school years or has at least 50 percent of its schools designated as underperforming for two consecutive school years (Sec. 1). - Allows a school board to remove a superintendent from office if, under that superintendent, the district is designated as underpeforming for two consecutive school years or has at least 50 percent of its schools designated as underperforming for two consecutive school years (Sec. 1). - Prevents a school board from removing a superintendent under the provisions of this act if the superintendent's employment contract exceeds the two consecutive school years during which the district was designated as underperforming, unless the school board pays the superintendent all compensation and benefits for the unexpired term (Sec. 1). - Prevents a superintendent who has been removed from office from seeking reelection until one full term has passed (Amnd. No. 1).

The county board of education will appoint a replacement for a term of not more than four years [Sec.1 (1)]. - Establishes election procedures for school board members and trustees starting on the first Tuesday after the first Monday in June 2009 and every four years thereafter [Sec. 2 (1)]. - Requires that all vacancies on the board of trustees must be filled through appointment within 60 days after the position becomes vacant [Sec. 2(2)] - Requires a county with six or more school districts consolidate the districts into not more than three districts with three school boards [Sec. 9 (1)(a)]
