Vote Smart's Synopsis:
Vote to concur with House Amendments and pass a bill that amends existing law as it pertains to abortion and includes provisions that would take effect if Roe v. Wade were overturned.
Highlights:
-Requires the court to grant a parental consent waiver if the court does not reach a decision within seventy-two hours of application for a waiver (Sec.1).
-Amends existing law to state that there must be "clear and convincing evidence" for the court to grant a waiver (Sec.1).
-Declares that anyone performing an abortion, except in cases "where necessary for the preservation of the mother's life or where the pregnancy was caused by rape," can receive a prison term of one to ten years (Sec.2).
-Requires that before a physician may perform an abortion he or she must perform an ultrasound, offer to let the patient view the ultrasound and hear the heart beat, offer a copy of the ultrasound to the patient, and have the patient certify that she was presented with the above information (Sec.3).
-Declares that the provisions of this bill are severable if any should be deemed unconstitutional (Sec.5).
-Provides that Sections 1, 3, 4 and 5 will take effect beginning July 1, 2007; and that Section 2 shall take effect ten days after the Attorney General publishes a determination that the Supreme Court has overturned the Roe v. Wade decision and that Section 2 would be constitutional (Sec.6).
