Vote to pass a bill establishing regulatory measures for confined feeding operations (CFOs) and confined animal feeding operations (CAFOs).
Highlights:
- Requires the construction of confined feeding operations (CFOs) and confined animal feeding operations (CAFOs) to be at least one mile from any public school, health facility, or municipality [SEC. 2 (sec. 1.5)(a)].
- Exempts new construction on an already existing CFO or within one mile of an existing CFO [SEC. 2 (sec. 1.5)(b)].
- Establishes civil penalties of $100-$25,000 per day for first time offenders, $500-$50,000 per day for repeat offenders, and $10,000-$100,000 per day for intentional violators [SEC. 5 (sec. 7)(c)].
- Requires an annually inspect of each feeding operation at the expense of the feeding operation [SEC. 6 (sec. 8)].
- Requires the state chemist to adopt rules for a CFO/CAFO manure application training program [SEC. 12 (sec. 18)(a)].
