Title: Unborn Victims of Violence Act 2004
Vote to pass a bill that would make it a criminal offense if a fetus/unborn child is injured or killed while carrying out a violent crime on a pregnant woman.
- Provides that offenses against the mother and against the fetus/unborn child shall be counted as separate offenses (Sec. 2).
- Provides that a conviction under this act does not require proof that the offender had knowledge of the woman's pregnancy or that the offender intended to harm the fetus/unborn child (Sec. 2).
- Provides that the death penalty cannot be imposed for an offense against a fetus/unborn child as defined in this act (Sec. 2).
- Exempts legal abortions from the provisions of this act (Sec. 2).
