Title: Indian Federal Recognition Administrative Procedures
Vote to suspend the rules and pass a bill that establishes a Commission on Indian Recognition that has jurisdiction over federal recognition to Indian tribes.
- Establishes criteria for determining which Indian groups qualify for Federal Recognition, including "substantially continuous" recognition as an American Indian entity since 1934.
- Requires that the Commission set a date for preliminary hearing within 60 days after receipt of a petition.
- Stipulates that within 30 days after preliminary hearing the Commission makes a determination regarding the federal recognition of the tribe.
- Appropriates $3 million annually to the Secretary of Health and Human Services for grants to Indian groups seeking Federal recognition.
- Appropriates $1.5 million to the Commission annually through fiscal year 2010.
NOTE: THIS VOTE WAS TAKEN UNDER A SUSPENSION OF THE RULES TO CUT OFF DEBATE EARLY AND VOTE TO PASS THE BILL, THEREBY REQUIRING A TWO-THIRDS MAJORITY FOR PASSAGE.
