Title: Partial-Birth/Late-Term Abortion Ban Act of 1995

Vote Smart's Synopsis:

Vote to pass a bill that prohibits any individual from knowingly performing the partial birth/late-term abortion procedure known as intact dilation and extraction, in which a fetus is partially delivered before it is aborted, unless the life of the woman is endangered and there is no other possible procedure.

Highlights:

  • Defines "partial-birth abortion" as an abortion in which the person performing the abortion partially vaginally delivers a living fetus before killing the fetus and completing the delivery.
  • Fines or imprisons, for not more than two years, any physician who knowingly performs a "partial-birth abortion" except where such an abortion is necessary to save the life of a woman endangered by a physical disorder, illness, or injury, provided that no other medical procedure would suffice.
  • Permits the husband (if married to the woman at the time she receives a "partial-birth abortion" procedure), or if the woman has not attained the age of 18 at the time of the abortion the parents of the woman, to seek monetary damages for all psychological and physical injuries equal to three times the cost of the partial-birth abortion; unless the pregnancy resulted from the plaintiff's criminal conduct or the plaintiff consented to the abortion.

  • Prohibits the father or maternal grandparents (if the mother is a minor at the time of the abortion) from seeking damages if the pregnancy resulted in the plaintiff's criminal conduct of the plaintiff consented to the abortion.
