Highlights:

  • Establishes three categories of licenses for growers, processers, provisioning centers, and other facilities dependent upon the number of plants that may be grown in the facility and other criteria (Sec. 401). 
  • Authorizes the Marijuana Licensing Board to fully and effectively oversee the operation of all marijuana facilities (Sec. 303). 
  • Authorizes a municipality to impose an annual license fee up to $5,000 (Sec. 205).  
  • Exempts a registered qualifying patient or registered primary caregiver from criminal prosecution for purchasing 2.5 ounces or less of marijuana, so long as the individual complies with the act(Sec. 203). 
  • Establishes a 3% tax on a provisioning center’s gross retail receipts (Sec. 801). 
  • Defines “provisioning center” as a commercial licensee in the state that purchases marijuana from a grower or processor and provides marijuana to registered qualifying patients and registered qualifying caregivers (Sec. 101).  
  • Specifies that all marijuana-related facilities are subject to examination by police (Sec. 208).  
  • Specifies that no license can be transferred, sold, or purchased without the permission of the Board (Sec. 406).  
  • Establishes the following civil fines for violating these provisions (Sec. 407): 
    • Up to $5,000 against an individual; and 
    • Up to $10,000 or amount equal to daily gross receipts, whichever is greater, against a licensee.
