Title: Prohibits Sale of Endangered Species Parts or Products

Vote to pass a bill that prohibits the sale or trade of animals, body parts, or products listed as an endangered species.

Highlights:

  • Prohibits the sale or trade of an animal or its body parts in any form if the animal is listed as an endangered species by the following (Sec. 2): 
    • Appendix 1 or 2 of the Convention on International Trade in Endangered Species;
    • The International Union for the Conservation of Nature's; or
    • The Endangered Species Act.
  • Specifies that this applies to animals including elephants, mammoths, rhinoceri, walruses and whales (Sec. 1). 
  • Exempts the sale or trade of an animal or its body parts if the following conditions are met (Sec. 2): 
    • It is distributed for an educational or scientific purpose or by a museum;
    • It is a fixed component of a larger manufactured item of which it is not the primary source of value;
    • The intrastate sale or trade is expressly authorized by a federal law or permit; or
    • It is explicitly protected as part of traditional cultural practice.
  • Exempts the following only if it contains less than 20% animal parts by volume (Sec. 2):
    • A bona fide antique that can be proven by documentation to be more than 100 years old;
    • A legally purchased and possessed firearm; or
    • A musical instrument manufactured no later than 1975.
  • Specifies that violators of the provision will be issued the following penalties (Sec. 3):
    • A fine of at least $200, imprisonment up to 1 year, or both for the 1st conviction;
    • A fine of at least $1,000, imprisonment up to 1 year, or both for the 2nd conviction within 5 years; or
    • A fine of at least $2,000, imprisonment up to 1 year, or both for the 3rd conviction within 5 years.
  • Specifies that, upon a 2nd or 3rd conviction, all animals, body parts, or products containing such, that are illegally sold or traded must be forfeited and disposed of by the state (Sec. 3).
