Title: Requires Overtime Pay for Farmworkers

Vote to concur with Senate amendments and pass a bill that requires overtime pay for farm workers, effective January 1, 2019.

Highlights:

 

  • Requires a graduated decrease of the number of hours a farm worker may work before receiving overtime pay, utilizing the following schedule (Sec. 2):

    • 9.5 hours in one workday or 55 hours in one workweek, beginning January 1, 2019;

    • 9 hours in one workday or 50 hours in one workweek, beginning January 1, 2020;

    • 8.5  hours in one workday or 45 hours in one workweek, beginning January 1, 2021; and

    • 8 hours in one workday or 40 hours in one workweek, beginning January 1, 2022.

  • Specifies that a farmworker must be compensated at least twice their regular hourly pay for any hours worked in excess of 12 in a day (Sec. 2).

  • Authorizes the governor to temporarily suspend scheduled phases under the following conditions (Sec. 2):

    • The governor suspends scheduled minimum wage increases; and

    • The full implementation of overtime requirements occurs no later than January 1, 2022.
