Vote to pass a bill that establishes a pilot program that authorizes a peace officer to conduct a roadside saliva drug test.

Highlights:

• Establishes a pilot program that authorizes a peace officer certified as a Drug Recognition Expert to conduct a preliminary oral fluid analysis on an individual operating a motor vehicle, if the officer has reasonable cause to believe that the individual is impaired by a controlled substance (Sec. 625R).

• Classifies the refusal of an individual to submit to an oral fluid analysis as a civil infraction, punishable by a fine of up to $100, imprisonment for up to 93 days, or both (Sec. 625R).

• Authorizes a peace officer to arrest an individual based in whole or in part on the results of an oral fluid analysis (Sec. 625R). 

• Specifies that the results of an oral fluid analysis are admissible in a criminal prosecution or an administrative hearing (Sec. 625R).
