Vote to pass a bill that requires physicians to disclose their probationary status, effective January 1, 2018.

Highlights:

  • Requires a licensed physician, chiropractor, podiatrist, acupuncturist, and licensing agencies to disclose his or her probationary status to patients if the probationary order occurred after January 1, 2017. (Secs. 2 &3).
  • Specifies that disclosure should occur if the physician is on probation under the following circumstances (Sec. 3):
    • Gross negligence;
    • Alcohol or substance abuse;
    • Repeated negligence from standard care;
    • Mental illness; and
    • Felony conviction that resulted from patient treatment.
  • Specifies that a physician is not required to disclose their probationary status if the visit occurred under emergency circumstances (Sec. 3).
