Title: Expands Eligibility for Medical Marijuana

Vote to concur with House amendments and pass a bill that expands eligibility for medical marijuana treatment.

Highlights:

  • Authorizes a physician licensed by and in good standing with the Louisiana State Board of Medical Examiners to recommend the use of medical marijuana to patients suffering “debilitating medical conditions”, in any form except inhalation or raw and crude marijuana (Sec. 1). 
  • Defines “debilitating medical condition” as the following diseases (Sec. 1): 
    • Cancer; 
    • Positive status for HIV or AIDS; 
    • Cachexia, or wasting syndrome; 
    • Seizure disorders, including epilepsy; 
    • Crohn’s disease; 
    • Spasticity; 
    • Muscular Dystrophy; and 
    • Multiple sclerosis. 
  • Specifies that the THC content of medical marijuana shall be at the lowest possible therapeutic level (Sec. 1). 
  • Requires the Louisiana Board of Pharmacy to develop and issue an annual specialty license for a pharmacy to dispense medical marijuana, not to exceed 10 licensees (Sec. 1).  
  • Requires the Department of Agriculture and Forestry to develop and issue an annual license for the production of medical marijuana, not to exceed 1 licensee (Sec. 1). 
    • Authorizes the Louisiana State University Agricultural Center and the Southern University Agricultural Center to have the first right of refusal to be licensed, either separately or jointly. 
    • Requires both University centers to provide written notice of their intent to become a licensed production facility by September 1, 2016. 
    • Authorizes either University to conduct research on medical marijuana if they become a production facility.
