Title: Requires Collection of DNA upon Arrest for a Felony Charge

Vote to pass a bill that requires the collection of DNA upon arrest on a felony charge.

Highlights:

  • Requires any individual 18 or older arrested for a felony to submit a DNA sample upon being booked into a jail or detention facility, unless one is already on file (Sec. 1).
  • Specifies that the DNA sample will not be analyzed and will be destroyed unless 1 of the following conditions has been met (Sec. 1):

    • The arrest was made upon a valid felony arrest warrant;

    • The person has appeared before a judge who has said that there was probable cause for the arrest; or

    • The person posted bond or was released prior to appearing before a judge and then failed to appear for a scheduled hearing.

  • Specifies that all DNA samples and records will be automatically expunged from the OSBI Combined DNA Index System Database under the following circumstances (Sec. 1):

    • The offense for which the person was arrested does not result in charges;

    • The state voluntarily dismissed the felony charge; or

    • The court dismissed the felony charge.

  • Requires blood or saliva samples to be taken by peace officers, the county sheriff, or employees or contractors of the county sheriff’s office who are properly trained to collect these samples (Sec. 1).
