Vote Smart's Synopsis:

Vote to pass a bill that amends medical marijuana regulations.

Highlights:

• Authorizes a licensed medical physician to order low-THC cannabis or medical cannabis for an “eligible patient,” if the physician determines that the potential benefits overcome the risks of treating the patient (Sec. 1).

• Defines “eligible patient” as an individual who has been diagnosed with a terminal condition by a physician which is confirmed by another independent board-certified physician (Sec. 2).

• Establishes 3 new cannabis “dispensing organizations” when 250,000 qualified patients register with the state (Sec. 1).

• Defines “dispensing organization” as an organization authorized by the Department of Health to cultivate, process, transport, and dispense low-THC cannabis, medical cannabis, and cannabis devices (Sec. 2).

• Requires a dispensing organization to package the cannabis in a receptacle with a label stating the following information (Sec. 1):
• A statement that the cannabis meets all state requirements;
• The name of the dispensing organization where the cannabis originated; and
• The batch number or harvest from which the cannabis originated.

• Requires a dispensing organization to have alarm systems, 24 hour video surveillance, and additional security measures in place (Sec. 1).

• Classifies the act of ordering medical cannabis without reasonable belief that the patient has a terminal condition as a first degree misdemeanor (Sec. 1).
