Title: Authorizes the Recreational Use of Marijuana

Vote on a motion to declare a bill inexpedient to legislate that authorizes the recreational use of marijuana, effective July 1, 2017.

Highlights:

  • Authorizes an individual of 21 years of age or older to possess, consume, purchase or transport up to 1 ounce of marijuana including up to 5 grams of hashish, and the equivalent amount in marijuana products (Sec. 1).
  • Authorizes an individual who is 21 years of age or older to possess, grow, and transport up to 6 marijuana plants, with no more than 3 being mature (Sec. 1).
  • Establishes a tax of $530 per ounce of marijuana flowers and a tax of $15 per ounce on all other parts of marijuana sold or transferred from a cultivation facility to a product manufacturing facility or retail store (Sec. 1).
  • Establishes a tax of 15 percent of the sale price for marijuana sold or transferred by a retail store (Sec. 1).
  • Authorizes an individual to cultivate, possess and use hemp (Sec. 1). 
  • Repeals the penalty of 3 years in prison, a fine of not more than $25,000, or both if an individual is in possession of less than 1 ounce of marijuana or less than 5 grams of hashish (Sec. 1).
