Vote to pass a bill that authorizes a pharmacist to decline to sell cold medicines used to make methamphetamine, effective July 1, 2016.

Highlights:

  • Requires a pharmacist to make a professional determination based on prior medication filling history as to whether there is a legitimate medical need before selling ephedrine or pseudoephedrine to an individual (Sec. 4).
  • Authorizes a pharmacist or a pharmacy technician to be immune from civil liability if he or she declines to sell ephedrine or pseudoephedrine to an individual (Sec. 4).
  • Authorizes a pharmacist to sell an alternative product to an individual who is declined ephedrine or pseudoephedrine, including the following products (Sec. 4):
    • An extraction-resistant form of ephedrine or pseudoephedrine;
    • A conversion-resistant form of ephedrine or pseudoephedrine; or
    • A product that contains up to 720 milligrams of ephedrine or pseudoephedrine per package and 30 milligrams per tablet.
