Title: Common Sense Nutrition Disclosure Act of 2015

Vote to pass a bill that amends certain nutrition disclosure requirements for restaurants.

Highlights:

  • Amends menu-labeling requirements to authorize a retail food establishment to disclose the number of servings and calories per serving of a menu item instead of the number of calories contained in the whole menu item (Sec. 2).
  • Authorizes a retail food establishment to disclose nutrient content statements in an online menu, if the establishment receives a majority of its orders from customers who are off the establishment’s premises (Sec. 2).
  • Authorizes a nutrient content statement to have a “reasonable” variation from the actual nutrient content of a food item, including, but not limited to, a variation in serving size or ingredients, or human error in preparation of menu items. (Sec. 2).
  • Specifies that an advertisement, coupon, flyer, window display, packaging, or social media is not required to disclose nutrient content statements (Sec. 2).
  • Prohibits a retail food establishment from being required to provide certification of compliance with menu-labeling requirements (Sec. 2).
  • Authorizes a retail food establishment to correct a violation of menu-labeling requirements within 90 days of notification of the violation (Sec. 2).
  • Prohibits a restaurant or food retailer from being liable for any civil claims resulting from a violation of the provisions of this bill (Sec. 3).
