Vote to pass a bill that prohibits the State from "substantially burdening" an individual's right to "exercise of religion."

Highlights:

• Prohibits “state action” from “substantially burdening” an individual’s right to “exercise of religion” unless the following conditions are met (Sec. 5).
• It is in a “compelling” governmental interest; and
• It is the least restrictive means of furthering that “compelling” governmental interest. 

• Defines “exercise of religion” as the practice or observance under the rights enumerated in the Constitution of the State of West Virginia and the Constitution of the United States of America (Sec. 5).

• Defines “state action” as an action by a branch, department, agency board, commission instrumentality, official or other individual acting under the law of the State of West Virginia (Sec. 5).
