Title: Specifies Determination of Need Score to Qualify for Assistance

Vote to override a veto of a bill that appropriates funds for home care and disability programs.

Highlights:

  • Specifies that an individual with a score of 29 or higher based on the Determination of Need (DON) assessment tool is eligible to receive institutional, home and community based long term care services (Secs. 5, 10 &15).
  • Prohibits a new assessment tool from causing more than 1% of currently eligible individuals to lose eligibility when implemented (Sec. 5).
  • Prohibits an institution from involuntarily discharging an individual receiving institutional care as a result of a new DON tool unless a transition plan has been created (Sec. 13).
