• Requires a law enforcement agency to destroy data collected by an “automated license plate reader” that is not related to an active investigation no later than 60 days after collection (Sec. 3).

• Defines an “automated license plate reader” as a device capable of recording or taking a photograph of a vehicle or its license plate and comparing the recording or photograph to an existing database for investigative purposes (Sec. 3).

• Requires a law enforcement agency to maintain a public record of information regarding the use of automated license plate readers (Sec. 3).

Vote Smart's Synopsis:

Vote to pass a bill that amends procedures for data collected by police surveillance equipment.

Highlights:

• Classifies “portable recording system data” as private data, unless the recording occurs in a public place and the following circumstances apply (Sec. 3):
• The data records an incident in which a police officer uses a weapon or physical coercion that causes substantial bodily harm; or
• The data records an individual who requests that the data be accessible to the public, provided that data on nonconsenting private individuals is redacted.

• Defines “portable recording system data” as audio or video data collected by a device worn by a police officer that is capable of recording the officer’s activities and interactions with other individuals (Sec. 3).

• Requires a law enforcement agency to destroy data collected by an “automatic license plate reader” 90 days after it is recorded, unless a written request preserves the data for a criminal investigation or legal complaint (Sec. 2).

• Defines “automated license plate reader” as an electronic device placed on a law enforcement vehicle or in a stationary location that records data on a vehicle license plate and compares the collected data and photos to law enforcement databases for investigation purposes (Sec. 2).
